Mediation occurs when the parties to a divorce attempt to resolve their family law dispute out of court with the help of a trained, professional mediator, often an experienced attorney. A mediator does not represent either party but remains an objective and unbiased third party who can review the facts and circumstances of each case, review the applicable law with the parties and likely outcomes to litigation and assist the parties with arriving at creative settlements involving the issues. If parties are successful at resolving their disputes through mediation, the mediator may then prepare a written document containing the parties' agreement. The parties typically leave mediation with a feeling of accomplishment as well as a feeling of closure.
